Terms of service

AZ Gate Doctor - Terms and Conditions of Service

These Terms and Conditions govern the provision of gate repair, installation, and related services ("Services") by GHC,LLC dba, AZ Gate Doctor ("the Business") to the client ("the Client") at the service location in Arizona.

1. Invoices and Payment

The Business will issue invoices upon completion of agreed milestones or the entire Project, unless a specific Payment Schedule is provided. Clients agree to pay invoices by the specified due date. Overdue invoices may lead to suspension or termination of services, and interest may be charged on late payments as permitted by Arizona law. Payment can be made via cash, check (payable to GHC,LLC dba, AZ Gate Doctor), approved payment cards (Visa, Mastercard, American Express, Discover, etc.), or other methods agreed upon in writing.

2. Warranty

  • Warranty Repairs: AZ Gate Doctor warrants its repair workmanship for a period of 90 days from the date of service completion. This warranty covers defects in the repair work performed.

  • New Installations: New gate installations are warranted against defects in workmanship for a period of 1 year from the date of installation completion. Material warranties are provided separately by the manufacturer.

This warranty does not cover damage resulting from misuse, neglect, acts of nature, or unauthorized modifications.

3. No Refunds

For repair services, acceptance of the completed service and any installed goods is assumed unless a written claim of defect or improper performance is received within 7 days of service completion. For new installations, written claims regarding installation defects must be made within 30 days of completion. Specific material warranty terms will be provided separately.

4. Licensing and Compliance

GHC,LLC dba, AZ Gate Doctor is a licensed and insured business operating in Avondale, Arizona, and surrounding areas. We comply with all applicable federal, state, and local laws and regulations in Arizona.

5. Authority

By engaging AZ Gate Doctor for services, both the Client and the Business confirm they have the authority to enter into this agreement and fulfill their respective obligations.

6. Termination

This agreement continues until the Project is completed as defined in the scope of work. Either party may terminate the agreement prior to completion. If the Client terminates without cause, they are responsible for payment for all work completed and costs incurred up to the termination date, including materials and reasonable cancellation fees. If the Business terminates due to the Client's breach (e.g., non-payment), the Client remains responsible for incurred costs.

7. Modifications

Any changes to these terms or the agreed scope of work must be documented in a written amendment signed by both the Client and AZ Gate Doctor. Verbal modifications are not binding.

8. Limitation of Liability

To the fullest extent permitted by law, AZ Gate Doctor's liability for any claims, damages, or losses arising out of or related to the Services provided shall be limited to the total amount paid by the Client to the Business for the specific services in question. AZ Gate Doctor shall not be liable for any indirect, incidental, consequential, or punitive damages.

9. Force Majeure

Neither party shall be liable for any failure or delay in performance under this agreement to the extent such failure or delay is caused by events beyond its reasonable control, including, without limitation, acts of God, natural disasters, war, civil unrest, strikes, or governmental actions.  

10. Dispute Resolution

Any controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place in Maricopa County, Arizona.
